The drink consists of Gosling’s Black Seal rum and ginger beer over ice, garnished with a lime. According to the Gosling family, the name was coined by a sailor who observed that the dark rum floating on top of the cloudy ginger beer looked like 'a cloud only a fool or a dead man would sail under.' Because Gosling Brothers Ltd. holds the trademark, it is legally required that any drink sold as a 'Dark 'n Stormy' must use Gosling’s rum. This is a rare example of a 'protected' cocktail recipe, similar to how certain food products like Champagne or Parmigiano-Reggiano are protected by geographic location laws.
